TANCREDO: Immigration ruling nixes state sovereignty - Washington Times


The Supreme Court twice last week abandoned the Constitution to give new powers to the federal government and the Obama administration. The question for conservatives and patriots is: What can be done about it?

In Monday’s Arizona ruling, the majority opinion, written by Justice Anthony M. Kennedy, creates a totally novel and illogical doctrine of federal pre-emption. In Thursday’s Obamacare ruling, Chief Justice John G. Roberts Jr. goes through unprecedented contortions to effectively rewrite the Patient Protection and Affordable Care Act as a taxation measure, not an unconstitutional expansion of the commerce clause.

It will strike many Americans as especially noxious and foolhardy to give Attorney General Eric H. Holder Jr. and his Justice Department lawyers such broad discretionary powers of law enforcement when Congress is moving toward removing him from office.

There also is a weird irony and alarming disconnect at play when the Supreme Court says the executive branch may defer to the feelings and interests of foreign governments in enforcing our immigration laws at the same time the Justice Department is under investigation for running an arms-smuggling operation in flagrant violation of Mexico’s sovereignty.

Though America may be in a rut, Heritage Foundation president Ed Feulner has an optimistic Fourth of July message for you: We’re still exceptional.
“America is exceptional because as immigrants from 194 countries over the years, we have shown it is the only place where you can come and start off with a clean slate,” he told The Daily Caller in an interview about his new book, “The American Spirit: Celebrating the Virtues and Values that Make us Great,” co-authored with Brian Tracy.
“In effect, you can define your own future. You can be whatever is possible as long as you are willing to work hard for it and make it happen on your own behalf. You are not automatically cast into a class system or a certain level of society which you can’t rise out of. You can really make a difference.”
“In short, America is not just a place: It is an idea.”
Asked whether he thinks President Obama believes in American exceptionalism the way he defines it, Feulner said “no.”
“President Obama has already said he does not believe in American exceptionalism the way we believe in it,” he said.
Feulner rejects the notion of an America in decline, saying that the nation’s challenges “aren’t greater than the country faced when we were in world wars, or when we were in the midst of the Great Depression.”

On the eve of Independence Day, many Americans are still digesting last Thursday’s ruling in which the U.S. Supreme Court declared that Congress has the authority to tax the free and independent people of the United States for the offense of not following orders Congress has given. Moreover, the content of those orders is limited only by the imaginations of the 535 members of Congress. 

What might the Founders of this nation, the men who risked death to secure for posterity the right to life liberty and the pursuit of happiness, think of such a turn of events? 

As Chief Justice John Roberts noted in his ruling, “the Government’s logic would justify a mandatory purchase to solve almost any problem.” However, he wrote, although Congress may not impose such mandates under the Commerce Clause, it may pass them and then tax anyone who disobeys. That calls to memory the colonial reaction to the little-remembered Declaratory Act of 1766.

Parliament’s attempt to tax Americans without representation via the Stamp Act of 1765 was a dismal failure. To temper the calls for rebellion, Parliament repealed the act. But in its place it passed the Declaratory Act, which asserted “the king’s Majesty... had, hath, and of right ought to have, full power and authority to make laws and statutes of sufficient force and validity to bind the colonies and people of America, subjects of the crown of Great Britain, in all cases whatsoever.”

The phrase “to bind the colonies and people of America... in all cases whatsoever” became a sort of patriot rallying cry in the 1770s. It is inconceivable that the men who rebelled against that would approve of ceding to Congress the power to order them to behave as Congress wishes.

President Obama wasted little time giving his perspective on the Supreme Court's decision to uphold his sweeping health care law.

"This is a good day for millions of Americans who can continue to benefit from the protections and economic security provided by the Affordable Care Act," Obama said in an emailed statement Thursday, a few hours after the ruling.

But for millions of Americans, it was just another bad day without the economic security of a job. The unemployment rate has held above 8% for 40 straight months. It ticked up to 8.2% in May, and would actually be around 11% if labor force participation wasn't at record lows.

A recent Gallup survey found that31% of Americans say the economy is their top concern. Another 25% cite unemployment. And health care? Just 6% say it's their No. 1 issue.
